All persons who wish to use (landing or otherwise) the Grahamstown Aerodrome and its facilities do so at their own risk and are deemed to agree to this indemnity:

I, hereby acknowledge that my use of the aerodrome and/or airfield and/or facility (the “airfield”) is potentially dangerous and that I make use of the airfield entirely at my own risk.

I undertake to inspect the airfield prior to using it and ensure it is safe for use prior to any landing or flight.  This shall include being observant of any animals, radio flyers, vehicles or personnel. I undertake to take whatever precautions are necessary to ensure that I utilise the airfield in a safe manner.

I indemnify and hold harmless, the Grahamstown Flying Club (GFC) and Makana Municipality, its Directors, employees, shareholders, lessees, members and agents from any and all claims, howsoever arising, and whether due to any act, omission or negligence on their part.

I note that this is municipal property and right of admission is reserved by the GFC. Any trespassers may be prosecuted.

I further understand, agree and accept that no claim has been made by the owners or its representatives that the airfield or runway is serviceable. I acknowledge that the airfield has other users in the form of persons and families and I accept that it is my responsibility to inspect the airfield including runways on approach, landing and take-off and while taxing to ensure absolute safety at all times. I agree to operate any aircraft in full compliance with any and all regulations including Civil Aviation Regulations and SAMAA procedures and regulations and I agree only to fly to or from the airfield, aircraft that are airworthy. I agree to maintain safe circuit patterns and altitudes with due consideration for the users of the airfield as well as the surrounding neighbours.

I further agree to brief any of my passengers and/or crew regarding the indemnity and will only allow a person onto the airfield after full acknowledgement of this indemnity and agree to read the following exerts to any crew/passenger/visitor before arriving at the airfield and obtain their agreement thereto:

“You have undertaken to fly in an aircraft that will operate in and out of Grahamstown airfield and/or will visit the premises, knowing and understanding and accepting that all operations in and around aircraft and the airfield may lead to damage or loss of your goods, injury or death to yourself. YOU ACCORDINGLY INDEMNIFY ALL PERSONS AND LEGAL ENTITIES WHO MAY BE CONSIDERED VICARIOUSLY LIABLE IN THE OPERATION OF ANY AIRCRAFT AND THE AIRFIELD FROM ALL AND ANY CLAIMS, WHETHER DUE TO THE ACT, OMISSION OR NEGLIGENCE OF THE PILOT, THE OWNER, GRAHAMSTOWN FLYING CLUB, ITS MEMBERS, LESSEES, EMPLOYEES OR AGENTS. Should you not agree to this indemnification, then you may not enter the premises, land or take-off from the airfield”
